The Midnight Academy Service Agreement

Effective Date: September 12, 2024

This Service Agreement ("Agreement") outlines the terms and conditions governing your enrollment and participation in courses offered by Midnight Academy, owned and operated by Dr. Heather Lynn. By enrolling in and accessing any course, you ("Student") agree to be bound by the following terms:

1. Eligibility

• Students must be 18 years of age or older to enroll in any Midnight Academy course. By enrolling, you confirm that you meet this age requirement.

2. Content Recording and Usage

• By enrolling in a live course session, you acknowledge that your name, video, and any other personal contributions made during the session may be recorded and made visible to future students within the course platform.
• These recordings are an integral part of the course experience and may be used for educational purposes by other students who join the program at a later time.

3. No Refund Policy

• All course sales are final. Midnight Academy has a strict No Refund Policy. By enrolling, you agree that you will not be eligible for any refunds after your purchase, regardless of the reason.

4. Lifetime Access

• Enrolled students are granted lifetime access to the course materials, subject to the following:
  • "Lifetime access" is defined as the availability of the course materials for as long as Midnight Academy operates and maintains the course platform.
  • In the event Midnight Academy discontinues a course or ceases operations, enrolled students will be provided with the opportunity to download full course files for archiving purposes.

5. Intellectual Property

• All course content, including videos, written materials, and any supplemental resources, are the intellectual property of Midnight Academy and Dr. Heather Lynn. Students are granted a non-transferable, non-exclusive license to access and use the content for personal, educational purposes only.
• Redistribution, reproduction, or sharing of course content outside the intended platform without prior written consent is strictly prohibited.

6. Prohibited Conduct

• You agree to use the course content in a lawful and respectful manner. Any form of harassment, abusive language, or inappropriate conduct toward instructors or fellow students will result in immediate removal from the course with no eligibility for refunds or further participation.

7. Privacy and Confidentiality

• Midnight Academy values your privacy and will take reasonable measures to protect any personal information shared during your participation in the course. However, you agree that your participation in live sessions may inherently include the sharing of personal information, which will be visible to other enrolled students.

8. Technology Requirements

• Students are responsible for ensuring they have the appropriate technology (including a stable internet connection) to access the course platform and participate in live sessions. Midnight Academy is not responsible for any technical issues on the student's end that prevent course access.

9. Changes to the Agreement

• Midnight Academy reserves the right to modify or update this Agreement at any time. Any changes will be communicated to students via email or through the course platform. Continued use of the platform after changes are made constitutes your acceptance of the updated terms.

10. Dispute Resolution

• Any disputes arising from this Agreement or the use of Midnight Academy’s services will be resolved through binding arbitration in accordance with [Insert Arbitration Rules], with the location of arbitration being [Insert Location].
